Just for a little background this is whats going on, apparently Illinois like many states is facing a lot of foreclosures. What you probably didn’t know is that its not because of the tenants but because of landlords struggling to pay the mortgage companies. Many times these people are paying their rent on time and unaware that of struggles the landlord is going through. The mortgage company isn’t seeing this and having tenants evicted while they are still paying. Sheriff Thomas J. Dart has decided to stop serving warrants for this reason. He stated “These mortgage companies don’t care about these people, to them they are just a piece of paper and all they want is their money regardless of who it hurts.”was elected to uphold the law and to fulfill the legal duties of his office, which include serving eviction notices.” The association also said Dart could be found in contempt of court for ignoring court eviction orders. The banks went on further to state “The reality is that by ignoring the law and his legal responsibilities, he is carrying out ‘vigilantism’ at the highest level of an elected official,”
See I have a major problem with charging a police officer of being in contempt of court when he is doing his job by protecting those innocent tenants from wrongful eviction. They are paying their bills on time there should be no reason for them to be evicted. The fault lies therein with landlord. Officer Dart is asking for legislation to be made to protect these innocent people most harmed by this current mortgage crisis.
So what do you think, should officer Dart be charged in contempt of court?
